  • You must be 18 years or older to use this Service.You must provide your legal full name, a valid email address, contact details and any other information requested in order to complete the signup/registration process and/or continued use of the Service. Brain Waves Clinic reserves the right to terminate your use of the Services upon the discovery that the information you provided is incomplete or inaccurate
  • Login to your account may only be used by one person – a single login shared by multiple people is not permitted
  • You agree not to share your username and password with other people. You are responsible for maintaining the confidentiality of your Service account and password. It is your responsibility to notify Brain Waves Clinic if you believe your username or password has been compromised or used in an unauthorized manner either with or without your knowledge. You are solely liable for any losses incurred to us, our affiliates, officers, directors, employees, consultants, agents, and representatives due to any misuse of your account or password
  • You shall not use the Service for any illegal or unauthorized purpose. You must not, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright or trademark laws)
  • You are responsible for complying with all applicable local, state, national and foreign laws related to your use of the Service. You shall not violate any applicable law or regulation; post or transmit any materials that violate any applicable local law; use the Service for any fraudulent or inappropriate purpose
  • Brain Waves Clinic may modify, suspend or discontinue this Service at any time, for any reason, at its sole discretion. Brain Waves Clinic reserves the right to refuse service to anyone for any reason at any time
  • Payments need to be made using valid banking credentials (credit card/debit card/net banking/etc.), unless otherwise specified. Free accounts are not required to provide any banking credentials.
  • The free account entitles new, registered users/entities to a free trial usage of the Service. It is provided at no cost to the user/entity. While using the free account, Brain Waves Clinic may restrict the length of time, number of days, storage limits, page views, number of participating members and the number of Appointments scheduled by the user. Brain Waves Clinic reserves the right to change the terms, cost and duration of the Free or any other Plans at any time. If the user desires additional services beyond the scope and limitations of the free account, then the user must subscribe to the Service as a paying customer. Any data you enter into the Services, and any customizations made to the services by us for you, during your free trial will be permanently lost unless you upgrade your subscription to one of paid plans.
  • The Services billed in advance ('Fees', 'Fee') will be non-refundable. There will be no refunds or credits for partial months of service, upgrade/downgrade refunds, or refunds for months unused with an open account. Brain Waves Clinic reserves the right to terminate or suspend an account for non-payment of subscription dues.
  • All Fees are exclusive of all taxes, levies, or duties imposed by taxing authorities, and you shall be responsible for payment of all such taxes, levies, or duties, legal compliances, statutory registrations and reporting.
  • Payment Method can be any of the two types:
    • i. Online: The Fees could be online through the facility made on the Website. Third parties support and services are required to process online fee payment. We are not responsible for any loss or damage caused to you during this process as these third parties are beyond the control of Brain Waves Clinic
    • ii. Offline: The Fees only in the form of cheque/DD could be either collected personally from you or couriered to us. The cheque/DD needs to be made to Brain Waves Clinic. We consider the payment process to be complete only upon receipt of the amount to Brain Waves Clinic’s designated bank account.
  • Fees not received within the specified due dates could attract late charges of up to 20% of the subscription fees, which may be levied at Brain Waves Clinic’s discretion
  • In case of non-payment of Fees within 45 days post the due date, Brain Waves Clinic reserves the right to discontinue the Services to you and delete all information in your Account, apart from reserving any legal recourse available.
  • Brain Waves Clinic does not accept any liability of loss of Content by downgrading your Service.
  • Brain Waves Clinic reserves the right to change the Service Fees upon 30 days’ notice. Such notice may be provided at any time by posting the changes to the Brain Waves Clinic site or the Service itself.
  • The responsibility of cancelling the account solely rests with the user. You may cancel your account at any time by sending an email to sudhirkothari@gmail.com with your intent of cancellation. There will be no cancellation Fees required.
  • Upon request, we could make arrangements to send you a copy of your data within 7 days from the time your cancellation request is processed.
  • There will be no refund made for any advance payments or fees that have been paid in advance.
  • Brain Waves Clinic may, at any time and for any reason terminate the Services, terminate this Agreement, or suspend or terminate your account. In the event of termination, your account will be disabled and you may not be granted access to your account or any files or other content contained in your account.
  • You agree that Brain Waves Clinic owns all rights to the code, databases, visual-design and layout, including all files and images contained in or generated by the software, and accompanying data, of the Service.
  • Brain Waves Clinic claims no intellectual property rights over the details/data you provide to the Service. Your account and details/data uploaded remain only yours. However, we may use this information for the proper management, provision, and administration of the Service and our business, and as required by law. We may also disclose information if required by law or if we obtain reasonable assurances from the recipient that such information will be held confidentially and used or further disclosed only as required by law or for the purpose for which we disclosed it. We will use appropriate safeguards to prevent the use or disclosure of the information other than as provided for by these Terms, including administrative, physical, and technical safeguards that reasonably and appropriately protect the confidentiality, integrity, and availability of the information.
